OFFICIAL CONTEST RULES

The purpose of the Clever Crazes for Kids Contest (the “Contest”) is to educate children 6 through 12 years old about self-esteem, sustainability, nutrition and fitness. No products or services are sold on this Web site and no purchase is necessary to participate or win.

Eligibility

The Contest is open to legal residents of the 50 United States and District of Columbia, ages 6 through 12 years, enrolled as students in a public school or a school that is a non-profit entity under Section 501(c)(3) of the Internal Revenue Code (either, a “Qualifying School”) at time of entry. Each student must be registered by a parent, guardian or teacher in order to participate. Only Qualifying Schools are eligible to receive Prizes except for the $5,000 Referral Prize which is available to any non-profit 501(c)(3) organization. No individuals are eligible to receive a Prize. The Contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law.

How to Register for the Contest

Only a parent, guardian or teacher may complete the Contest registration information at clevercrazes.com (the “Contest Site”). The parent, guardian or teacher must provide his or her full name, e-mail address, password, account PIN number, and the student’s first name, gender, grade level and school. Each parent, guardian, or teacher may register multiple children who will share the login password of such parent, guardian or teacher. The Contest registration information must be completed and submitted in electronic format only from the Contest Site. Registration information may be submitted at any time during a Contest Segment discussed below under Prizes. To compete for prizes for a student’s school, each student must follow all online instructions to score points for the student’s school by answering the educational questions on the Contest Site. Participants are subject to all notices for the Contest posted on the Contest Site, including, but not limited to, the Privacy Policy [LINK]. Online entries made with multiple email addresses, under multiple identities or through the use of any other device or artifice to enter a student multiple times will be deemed invalid. Sponsor reserves the right to permanently disqualify any person from the Contest if he/she has violated these Official Rules.

Contest Prizes for Winning Schools

All prizes will be awarded to the WINNING QUALIFYING school EXCEPT FOR THE $5,000 REFERAL PRIZE WHICH IS AVAILABLE TO ANY NON-PROFIT 501(c) (3) organization. No PRIZES WILL BE GIVEN TO INDIVIDUALS. THE AWARD WILL BE MADE PAYABLE TO THE WINNING SCHOOL OR NON-PROFIT ORGANIZATION. SCHOOLS WILL NEED TO FOLLOW THEIR DISTRICT’S POLICIES AND PROCEDURES REGARDING THEIR TREASURER’S DISTRIBUTION OF FUNDS.

There will be five contest segments: (1) from August 1, 2009 through September 30, 2009; (2) from October 1, 2009 through November 30, 2009; (3) from December 1, 2009 through January 31, 2010; (4) from February 1, 2010 through March 31, 2010; and (5) from April 1, 2010 through  May 15, 2010 (each a “Contest Segment”).  Points earned after May 15, 2010 will accumulate in the first contest segment of the new school year, which begins August 1, 2010 and continues through September 30, 2010.

For each Contest Segment, the following Prizes will be awarded:

Two Grand prizes of $5,000 each will be awarded at the end of each Contest Segment:


1) To the school, with a minimum of 100 students in its student body, which has the highest percentage of students participating. In the event of a tie, the tie-breaker will be based upon the highest number of total points scored on the Web site by that school’s students, provided that the school has not previously won this prize in this category during this school year. If the school that has the highest percentage of students participating has previously won this prize in this school year, the winner of the prize will be the school with the second highest percentage of students participating. If there is a tie after the highest number of total points scored is determined, the next tie-breaker will be based on the school that had the first student playing a game in that Contest Segment.

2) To the school whose student scores the highest number of individual points on the Web site during that Contest Segment provided that the same student did not win this prize in the immediately preceding Contest Segment. If the student with the highest number of individual points did receive the award in the preceding Contest Segment, the award for this segment will go to the student with the next highest number of individual points in this Contest Segment. In the event of a tie, the tie-breaker will be based upon the highest combined total points scored by that student and by the student at the same school with the other highest number of individual points. If there is a tie after the highest combined total points scored by the two students is determined, the next tie-breaker will be based on the school that had the first student playing a game in that Contest Segment. Family members of employees of Clever Crazes for Kids are not eligible to win in the category of students who score the Highest Number of Individual Points on the Web site during any Contest Segment.

Two second place prizes of $3,000 each will be awarded at the end of each Contest Segment:


1) To the school, with a minimum of 100 students in its student body, which has the second highest percentage of students participating, provided that the same school did not win a prize in this percentage of participation category during this school year. If the school that has the second highest percentage of students participating has previously won a prize in this category during this school year, the winner of the prize will be the school with the third highest percentage of students participating. In the event of a tie, the tie-breaker will be based upon the highest number of total points scored by that school’s students. If there is a tie after the highest number of total points scored is determined, the next tie-breaker will be based on the school that had the first student playing a game in that Contest Segment.

2) To the school whose student scores the second highest number of individual points on the Web site during that Contest Segment. If the student with the second highest number of individual points has either won during the immediately preceding Contest Segment or has been declared the winner of the first prize for this Contest Segment due to the student scoring the highest number of points being ineligible to receive the first prize in two consecutive Contest Segments, the student with the next highest number of points will be declared winner of the second place prize In the event of a tie, the tie-breaker will be based upon the highest combined total points scored by that student and by the student at the same school with the other highest number of individual points. If there is a tie after the highest combined total points scored by the two students is determined, the next tie-breaker will be based on the school that had the first student playing a game in that Contest Segment. Family members of employees of Clever Crazes for Kids are not eligible to win in the category of students who score the Highest Number of Individual Points on the Web site during any Contest Segment.

Two third place prizes of $2,000 each will be awarded at the end of each Contest Segment:


1) To the school with a minimum of 100 students in its student body with the third highest percentage of students participating, provided that the same school did not win a prize in this percentage of participation category during this school year. If the school that has the third highest percentage of students participating has previously won a prize in this category during this school year, the winner of the prize will be the school with the fourth highest percentage of students participating. In the event of a tie, the tie-breaker will be based upon the highest number of total points scored on the Web site by that school's students. If there is a tie after the highest number of total points scored is determined, the next tie-breaker will be based on the school that had the first student playing a game in that Contest Segment.

2) To the school whose student scores the third highest number of individual points on the Web site during that Contest Segment. If the student with the third highest number of individual points has either won during the immediately preceding Contest Segment or has been declared the winner of the second prize for this Contest Segment due to the student scoring the highest number of points being ineligible to receive the second prize in two consecutive Contest Segments, the student with the next highest number of points will be declared winner of the third place prize. In the event of a tie, the tie-breaker will be based upon the highest combined total points scored by that student and by the student at the same school with the other highest number of individual points. If there is a tie after the highest combined total points scored by the two students is determined, the next tie-breaker will be based on the school that had the first student playing a game in that Contest Segment. Family members of employees of Clever Crazes for Kids are not eligible to win in the category of students who score the Highest Number of Individual Points on the Web site during any Contest Segment.

Additional Prize Opportunity:


One additional $5,000 prize will be awarded at the end of each Contest Segment: This prize will be awarded to the school or non-profit organization whose employee refers the greatest number of new schools which enroll in the contest during each Contest Segment. The reason for this prize is to encourage educators to reach the greatest number of kids with this educational opportunity. This prize could be considered the Third Grand Prize per Contest Segment and is equal in dollar value to the other Grand Prizes described above.

Each Prize is non-assignable and non-transferable. Any taxes or other incidental expenses related to each Prize not specified herein are the sole responsibility of winning schools.

Winning Schools

Winning schools will be determined within 30 days of the end of each Contest Segment. Winning schools will be notified by e-mail or telephone and will be required to complete and return an Affidavit of Eligibility and a Publicity Release (“Affidavit/Release”) within 14 days of the date specified on the notice. If the Affidavit/Release is not returned as requested, it will result in disqualification, and the Prize will be awarded to an alternate winner. No substitutions of the Affidavit/Release are permitted.

General

Registration constitutes the certification by the parent, guardian or teacher that the student being registered for the Contest satisfies the eligibility requirements for participation. A Qualifying School’s acceptance of a Prize constitutes permission to use the school’s name, Prize won, location, and likeness for online posting and promotional purposes without further compensation, except where prohibited by law.

Registrants agree to these Official Contest Rules and the decisions of the Sponsor, and release the Sponsor, and all other businesses involved in this Contest, as well as the employees, officers, directors and agents of each, from all claims and liability relating to their participation. Winning schools assume all liability for any injury or damage caused or claimed to be caused by participation in this Contest or receipt or use of the Prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the Prize. Sponsor reserves the right to modify the Contest and the rules of the Contest in any way or at any time. Sponsor reserves the right, in its sole discretion, to cancel or suspend the Contest for any reason, including, but not limited to, if computer viruses, computer bugs or other causes beyond Sponsor’s control corrupt the administration, security or proper play of the Contest. Sponsor is not responsible for computer equipment failures or for transmission problems in the event an online entry is not received, points are not scored or there is damage to an entrant’s equipment due to participation in the contest.

The Contest shall be governed by Ohio law. By participating in the Contest, registrants agree that any dispute or controversy arising from or relating to this Contest shall be resolved in a federal or state court located in Cincinnati, Ohio, and registrants waive any objection they have or may have to this venue and irrevocably submit to the jurisdiction of such courts.

Ownership

All contents of the Contest are the property of the Sponsor. The contents may not be copied, distributed, or transmitted in any way without the prior written consent of the Sponsor. The content may not be modified in any way, and any copyright or trademark notice may not be deleted.
